Holographic will: It is not enough to simply deny the authenticity

To contest the autenticity of the holographic will – entirely handwritten, dated and signed by the testator – it is mandatory to request an official verification of the origin of the will. It is not enough to simply deny the authenticity, what stated must be proven. “The burden of proof lies with the claimant requesting to ascertain the origin of the document not by the one who apparently seems to be the author.” (Cass. Civ. n. 1995/2016, Cass. Civ. S.U. n. 12307/2015).
